TERMS & CONDITIONS
Shibari Studio Berlin

Last updated: 04.08.2026. These terms apply to all bookings and purchases made through www.shibari-studio.com. The contract language is English.

1. Provider

The contractual partner is Dan Carabas, trading as Shibari Studio Berlin, Hannoversche Str. 19A, 10115 Berlin, Germany ("we", "us", "the Studio"). Contact: info@shibari-studio.com. Full provider details are set out in our Imprint.

2. Scope & our offerings

These Terms govern all contracts between us and you ("the customer") for:

  • Workshops and events – group Shibari and Tantric Shibari workshops and other dated events;

  • Private tuition & sessions – individually scheduled tuition or sessions;

  • Online courses & digital content – online video courses, downloads and other digital products ("digital content");

  • Store products – ropes, tools, gift cards, artworks and other physical goods.

By booking or purchasing, you accept these Terms. Where you act as a consumer, your statutory rights remain unaffected.

3. How a contract is formed

Displaying products, courses or events on the website is an invitation to purchase, not a binding offer. By completing the checkout and clicking the payment/booking button you make a binding offer. The contract is concluded when we confirm your booking or purchase by email, or – for digital content – when we grant access. For events, your place is only reserved once payment is received.

4. Prices & payment

All prices are final prices in Euro and include German VAT where applicable. For physical goods, any shipping costs are shown before you complete the order. Payment is processed through the payment methods offered at checkout. Access to digital content and confirmation of event places are subject to receipt of full payment.

5. Delivery & access

Store products are shipped to the address you provide; delivery times and any shipping costs are stated at checkout.

Digital content / online courses is made available for online access and/or download immediately after purchase, or at the start date stated for the course. You need a suitable internet connection and device; technical requirements are stated on the product page.

Workshops, events and private sessions take place at the time and location stated in your booking confirmation.

6. Right of withdrawal (consumers)

If you are a consumer, you generally have a statutory 14-day right of withdrawal for physical goods and digital content. Details, conditions and the model withdrawal form are set out in our separate Right of Withdrawal / Cancellation Policy.

Important exceptions:

  • Workshops, events and dated sessions: the statutory right of withdrawal does not apply to leisure-service bookings tied to a specific date (§ 312g (2) no. 9 German Civil Code). These are governed by our cancellation policy in section 7 below.

  • Online courses / digital content: your right of withdrawal expires once we begin delivery of the digital content, provided you have expressly consented to immediate delivery and acknowledged that you thereby lose your right of withdrawal. You give this consent by ticking the corresponding box at checkout.

  • Gift cards are treated under section 8.

7. Cancellation, transfers & refunds (workshops, events & sessions)

Places are limited and require significant planning, space coordination and preparation, so the following cancellation policy applies to workshops, events and group sessions. The full version is set out on our Cancellation & Booking Policy page.

Cancellation deadlines:

  • 14+ days before the workshop: full refund minus a €20 administrative fee.

  • 7–13 days before: 50% of the workshop fee is refundable.

  • Less than 7 days before: no refund, unless your spot can be filled from the waitlist.

  • Transfers & substitutions: You may transfer your spot to another participant at no additional charge. Please notify us by email at least 24 hours before the event. If the workshop has a waiting list and we can fill your spot, you may be eligible for a partial refund (minus admin fee).

  • Non-attendance / no-show: If you do not attend the workshop and have not informed us in advance, no refund or credit will be issued.

  • Workshop cancellation by us: In the rare case that we must cancel or reschedule the workshop (e.g. due to illness, venue issues, or insufficient registrations), you will receive a full refund or the option to transfer to a future date.

  • How to cancel or transfer: Email: info@shibari-studio.com. Please include your full name, booking reference (if applicable), and whether you're requesting a cancellation or transfer.

Additional notes:

  • If you're experiencing illness or a personal emergency, we encourage open communication — we're happy to work with you where possible.

  • Refunds are typically processed within 7–10 business days.

  • Workshops, events and dated sessions are leisure services tied to a specific date. The statutory 14-day right of withdrawal does not apply to them (§ 312g (2) no. 9 German Civil Code); the terms above apply instead.

8. Gift cards & vouchers

Gift cards are valid for twelve months from the date of purchase and can be redeemed for our workshops, sessions, digital content or store products. They are transferable, cannot be exchanged for cash, and are not refundable except where required by law.

A gift card represents its monetary value and can be redeemed against our offerings available at the time of redemption. We do not guarantee that a specific workshop, format, date, product or price available at the time of purchase will still be offered when the gift card is redeemed. If an offering is no longer available, the gift card retains its monetary value and may be applied to another offering of equal value; any difference in price is settled at redemption.

9. Participation requirements, health & assumption of risk

This section applies to workshops, events and private sessions.

Shibari (Japanese rope art) is a physical practice involving rope tension, restricted movement, pressure on the body and, in some formats, suspension. It carries inherent risks including nerve compression or damage, numbness, bruising, skin marks, restricted circulation, muscle or joint strain, falls, dizziness and emotional responses. By booking you confirm that you understand and accept these risks and that you take part of your own free will and at your own risk.

You confirm that you are in a physical and mental condition that allows safe participation, and that you will inform the instructor before the session of any relevant condition (for example circulatory or heart conditions, nerve or joint problems, recent injury or surgery, pregnancy, epilepsy, or any medication affecting balance, sensation or consciousness). You will follow the instructor's safety guidance, communicate pain, numbness or distress immediately, may stop at any time, and will not participate under the influence of alcohol or drugs. The instructor is not a medical professional and provides no medical advice.

Instruction may involve the instructor adjusting your body or the ropes. You consent to necessary physical contact for teaching purposes and may withdraw this consent at any time.

10. Code of conduct & consent

Participation requires respect for personal boundaries and consent at all times. We may refuse or end participation without refund in the event of disrespectful, unsafe, harassing or intoxicated behaviour.

11. Online courses – licence & permitted use

When you purchase digital content or an online course, you receive a non-exclusive, non-transferable licence for your own personal, private use only. You may not copy, share, resell, publicly display, sub-licence, record or redistribute the content, provide access credentials to third parties, or make it available on any network. All content remains our intellectual property. Breach of this section entitles us to revoke access without refund, without prejudice to further claims.

12. Liability

We are fully liable for injury to life, body or health caused by our negligence, and for damage caused by intent or gross negligence. For slightly negligent breaches of an essential contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible and on which you may reasonably rely), our liability is limited to the foreseeable damage typical for this type of contract. Any further liability is excluded. This does not affect liability under the Product Liability Act or under any guarantee we expressly give. Nothing in these Terms excludes or limits liability where it may not be excluded or limited by law.

13. Age requirement

Our workshops, sessions, events and adult-themed content are for participants aged 18 and over. We may ask for proof of age.

14. Intellectual property

All texts, images, videos, course materials and designs on this website and within our digital products are protected by copyright and owned by Dan Carabas. Any use beyond the licence granted in section 11 requires our prior written consent.

15. Studio rental (space hire)

We also offer hire of our studio space ("Studio Rental"). The following applies in addition to the general terms; cancellation of a rental booking follows section 7.

  • Space only: When you book the Studio Rental you rent the space and the listed equipment only. You are fully responsible for your own activities, models, guests and equipment during the rental period.

  • Use at your own risk: Suspension points (bamboo and ring) and all rigging equipment are provided without guarantee and are used entirely at your own risk. We assume no liability for injuries, damage or loss of personal property arising from your use of the space or equipment, except for injury to life, body or health, or damage caused by our intent or gross negligence.

  • Care of the space: You must treat the studio, equipment and furnishings with care and leave them in the condition in which you received them.

  • Damage charges: Damage caused during your rental is charged at replacement cost, in particular:

    • Paper backdrop / paper wall: €100 per damaged section.

    • Scratching of a tatami mat: €100 replacement cost per tatami mat.

  • Private use / commercial licence: Listed rental prices apply to private, personal use only. Any commercial use of images or footage — by you or a third party — (e.g. brand or advertising campaigns, product promotion, paid social ads, business websites, press/PR, editorials with commercial intent, or any monetised content) requires a separate commercial licence and quote.   • Prices. All rental prices include 19% VAT.

16. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where you are a consumer with habitual residence in the EU, you also enjoy the protection of the mandatory provisions of the law of your country of residence. Should any provision of these Terms be or become invalid, the validity of the remaining provisions is unaffected.
